1. How to Enter the Contest:
a. The WJBQ “Q Baby Idol” contest will begin on Saturday, 3/31/12 at 12am and will end on Tuesday, 5/1/12 at approximately 9am.
b.To participate in the contest, listeners must provide a photo of their baby, who must be 2 years of age or younger by 3/31/12. Babies must be born between 3/31/10 & 3/31/12. (Verification of birth date will be required before prize is awarded.) Submissions are through the WJBQ website: www.wjbq.com. All fields in the on-line entry form are required. Photos submitted in person shall become the property of Station and will not be returned. Babies born on or after 4/1/12 are ineligible for this contest. Photos submitted must be in a JPG format; no other file formats will be accepted. The photo file maximum is 220 MB. All entries/photos must be submitted by 5pm on 4/13/12. Photos may be submitted in person at WJBQ Office by appointment only. Station is not responsible for entries not received due to difficulty accessing the internet, service outages or delays, computer difficulties or other technological glitches. Station is not responsible for any lost, disconnected, dropped, misdirected or incomplete telephone calls. Entrants may be disqualified at the sole discretion of the station.
c. No purchase necessary to enter or win. A purchase will not increase your chance of winning. Void where prohibited. Participants may only submit one entry per child. If more than one child is depicted in a single photo, it shall be considered a single entry that includes all children depicted and this photo will be displayed only once for the purpose of voting. Copyright photos from studios are NOT allowed without accompanying express written consent from the studio of origin.
2. Eligibility Restrictions:
a. The contest is open to all WJBQ listeners who are legal United States citizens 18 years of age or older. Entrant must be the legal guardian of the baby whose photo is submitted. Employees of WJBQ , its licensee, Cumulus Media, their affiliated entities, affiliated advertising agencies, participating sponsors/promotional partners, other radio stations and the members of their immediate families are ineligible to participate or win. Immediate family shall include spouse, parents, children, siblings, grandparents, grandchildren and any other person residing within the same household. Prior winning parents of Q Baby Idols are ineligible to win.
b. Listeners are eligible to win a WJBQ contest only once every thirty days. Only one winner per household is permitted in any contest.
c. Participants in the contest must possess valid government issued photo identification. Winner of record is the adult who submits the photo to WJBQ.
d. By entering this contest, participants consent to the unrestricted use, publication, editing, broadcast, duplication and distribution by Station, or its representatives, now and in the future, whether for commercial sale or otherwise in any medium whatsoever, of any material submitted in connection with their participation in the Contest. All such material shall become the sole property of Station. Participants acknowledge and understand that Station is and shall be the sole and exclusive owners of the Contest material, including all copyrights and other intellectual property rights, and shall have the right to exploit the Contest performances in any manner and any media whatsoever. Participants hereby assign to Station, its parent, subsidiaries, affiliates, successors and assigns, whatever rights or interest they or their child may now or ever have in the material by virtue of the child’s appearance therein or for any other reason, including but not limited to any rights that they may have to any proceeds arising out of the production, sale or other use of the materials.
3. Prizes:
a. A total of one (1) Grand Prize will be awarded in this contest. Grand Prize: Grand Prize Winner will receive $1,000 USD. Prize may be delivered to the Grand Prize winner in the form of a check, major credit card gift card or combination of both.
b. All prizes or prize certificates may be picked up at the office of WJBQ - One City Center, Portland, ME 04101. Any prize or prize certificate not claimed within forty five days of winning will be forfeited by the winner. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its arrival. WJBQ is not responsible for the safe arrival of a prize or prize certificate.
c. Contest prizes are not transferable. Prizes may not be substituted for or redeemed for cash.
d. Grand Prize winner will receive 1099 IRS Tax form for the value of the grand prize as stated in these contest rules.
e. Prizes are limited solely to those items explicitly set forth herein and shall not include any and all other expenses, incidentals or taxes that may arise out of the winner’s receipt of this prize.
f. Winner will be required to sign a liability release prior to receipt of their prize.
4. Selection of Winners:
a. Decisions of station management with respect to the contest are final.
b. Grand Prize winner will be determined by votes received during contest voting period. During the Voting Period, which shall be from 4/14/12 at 12am EDT – 4/27/12 at midnight EDT, all eligible submitted pictures will be placed on the WJBQ website and be designated a unique number. Voters must then vote for the picture they consider to be the best, using one of the voting methods described herein. Voters may vote an unlimited number of times per day per computer. There is also no limit on the number of TEXT votes that will be accepted. Text votes using any automated system are ineligible and will be discarded. There are two different methods for voting:
1) Voters may text message their vote. Text votes are to be made as follows: Send a text to 68255 with keyword: Qbaby (this MUST be first in the body of the message), followed by a space and then ONLY the NUMBER of the baby as assigned by WJBQ on the website and no other information (providing additional information may result in the disqualification of the vote).
2) You may also vote ONLINE at http://www.wjbq.com. There is no limit to the number of times that you may vote online.
c. The winner will be announced on 5/01/12at approximately 9am. Grand Prize Winner will be contacted by either phone or e-mail, based on the contact information that they provided in their registration.
5. Conditions:
a. Payment of all federal, state and local taxes are the sole responsibility of the winner. Winners will be required to sign an IRS Form W-9 or the equivalent. Failure or refusal to execute the release will result in winner forfeiting the prize. Photo identification and social security number of the Grand Prize winner may also be required in order to collect the prize.
b. By participating in the contest, the winner agrees to have their name, voice, or likeness and that of their baby used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and to sign a publicity release prior to acceptance of the prize.
c. Contest winners will be required to sign a liability release prior to acceptance of any prize valued at $600.00 or greater or which prize includes the provision of transportation, whether or not such transportation is provided by WJBQ. Pursuant to the liability release, the winners will agree to hold WJBQ, its licensee, Cumulus Media, their affiliated companies and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
d. WJBQ, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the WJBQ Web Site or who is otherwise in violation of the rules. The station further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
6. WJBQ reserves the right in its sole discretion to modify the contest rules and dates at any time for any reason. Material modifications shall be announced on-air, when practical. By participating in this contest, you agree to be bound by these contest rules, any modifications thereof, and by all other rules imposed by Station management. If due to circumstances beyond the control of Station, any event associated with this contest or the prize is delayed, rescheduled, postponed or canceled, WJBQ reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.
7. Failure to comply with the contest rules may result in a contestant's disqualification, at the sole discretion of WJBQ ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, STATION RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
8. WJBQ is not responsible for typographical or other errors in the printing, the offering or the administration of the contest or in the announcement of a prize.
9. Copies of the written contest rules and a list of all winners are available during regular business hours at the main studio of WJBQ, One City Center, Portland, ME 04101 or by sending a self-addressed stamped envelope to WJBQ at this address.
